Privacy Policy

When we say “TomerTalk,” “our,” “we,” or “us,” we’re talking about Membersoft, LLC, d/b/a TomerTalk. This Privacy Policy (“Privacy Policy”) applies to all of our apps, services, features, software, and website (together, “Services”) unless specified otherwise.

Please also read our Terms of Service (“Terms”), which describes the terms under which you use our Services.

Information we collect

TomerTalk receives or collects information when we operate and provide our Services, including when you install, access, or use our Services.

Information you choose to give us

Account information. You provide information when creating and maintaining a TomerTalk account. For example, you provide details about you, such as: your name, email address, a password, profile pictures, about information, your phone number, the phone numbers in your in your mobile address book on a regular basis, including those of both the users of our Services and your other contacts.

Payment Method. When you add a credit card or payment method to your account, a third party that handles payments for us will receive your card information. To keep your financial data secure, we do not store full credit card information on our servers.

Messages. You provide us with whatever information you send or receive through our Services. We retain your messages (including your chats, photos, videos, and files) in the ordinary course of providing our Services to you. We may choose to delete your messages that are older than 30 days from our servers. When you delete messages from your account, they are deleted from our servers. Please use common sense when using our Services and do not send messages or share content that you would not want someone to save or share.

Your contacts. To help you organize how you communicate with others, we provide you with ways to create and store your contacts on our servers. You confirm that you are authorized to provide us with such information (including email addresses and phone numbers) and you acknowledge and accept that this information will get associated with your account information.

Contacting us. When you communicate with us, we collect whatever information you volunteer.

Information we automatically collect

Usage information. We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use our Services, how you interact with others using our Services, how you communicate with others, the number of messages you exchange, the time and date of your communications, and the like), log files, and diagnostic, crash, website, and performance logs and reports. This also includes information about when you registered to use our Services, the features you use, when you last used our Services, and when you last updated your information.

Device and connection information. We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, battery level, signal strength, app version, browser information, and mobile network, connection information including phone number, mobile operator or ISP, language and time zone, and IP, device operations information, and identifiers.

Device phonebook. We may, with your consent, collect information from your device’s phonebook.

Camera and photos. Many of our Services require us to collect images and other information from your device’s camera and photos. For example, you will not be able to send or upload photos from your camera roll unless we can access your camera or photos.

Location Information. When you use our Services we may collect information about your location. We collect device location information if you use our location features, such as when you choose to share your location with your contacts, view locations nearby or those others have shared with you, and the like, and for diagnostics and troubleshooting purposes such as if you are having trouble with our app’s location features. With your consent, we may also collect information about your precise location using methods that include GPS, wireless networks, cell towers, Wi-Fi access points, and other sensors, such as gyroscopes, accelerometers, and compasses.

Information from third parties

Information others provide about you. We may collect information that other users provide about you when they use our services. For example, if another user allows us to collect information from their device phonebook, and you are one of that user’s contacts, we may combine the information we collect from that user’s phonebook with other information we have collected about you. We may also obtain information from any other third party sources, and combine that with the information we collect through our Services.

Third party providers. We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with companies to distribute our apps, provide our infrastructure, delivery, and other systems, supply map and places information, process payments, help us understand how people use our Services, and market our Services. These providers may provide us information about you such as demographic data, payment information, or fraud detection information.

How we use information

We use all the information we have to help us operate, provide, improve, understand, customize, support, and market our Services.

Our Services. We operate and provide our Services, including providing customer support, and improving, fixing, and customizing our Services. We analyze and use the information we have to evaluate and improve our Services, research, develop, and test new services and features, and conduct troubleshooting activities. We also use your information to respond to you when you contact us. We may also store some information locally on your device. For example, we may store information as local cache so that you can open the app and view content faster.

Communications about Our Services. We communicate with you about our Services and features and let you know about our terms and policies and other important updates. We may provide you marketing for our Services.

Safety and security. We promote safety and security on and off our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally. We may verify your identity and prevent fraud or other unauthorized activity.

Commercial messaging. We allow you and third parties, like businesses, to communicate with each other using TomerTalk, such as through order, transaction, and appointment information, delivery and shipping notifications, product and service updates, and marketing. For example, you may receive status information for something you purchased, or a notification when a delivery will be made. Messages you may receive containing marketing could include an offer for something that might interest you. We provide and improve ad targeting and measurement, including through the use of your precise location data (again, if you’ve consented to us collecting that data), both on and off our services.

Retention. To preserve the integrity of our Services, we may also retain information submitted by users for an indefinite length of time, even after the termination of your account or your relationship with us.

How we share information

You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.

Account information. Your phone number, name, and profile photos may be available to anyone who uses our Services.

Your contacts and others. Users with whom you communicate may store or reshare your information (including your phone number or messages) with others on and off our Services.

Third parties. We may share information about you with service providers who perform services on our behalf, sellers that provide goods through our services, and business partners that provide services and functionality. We may also share with third parties, such as advertisers, aggregated, non-personally identifiable, or de-identified information. We may share information about you if we reasonably believe that disclosing the information is needed to: (a) comply with any valid legal process, governmental request, or applicable law, rule, or regulation, (b) investigate, remedy, or enforce potential Terms of Service violations, (c) protect the rights, property, and safety of us, our users, or others, and (d) detect and resolve any fraud or security concerns.

Third party integrations. Our Services may contain third party links and search results, include third party integrations, or offer a co-branded or third party-branded service. Through these links, third party integrations, and co-branded or third party-branded services, you may be providing information (including personal information) directly to the third party, us, or both. You acknowledge and agree that we are not responsible for how those third parties collect or use your information. As always, we encourage you to review the privacy policies of every third-party service that you visit or use, including those third parties you interact with through our services. Third party integrations include Stripe, Inc.[LINK] for payment processing and Twilio, Inc.[LINK] for messaging.

Regarding children

Children under the age of 13 are not permitted to use TomerTalk and we do not intentionally collect or maintain personal information from those who are under 13 years old. We recommend that children between the ages of 13 and 18 obtain their parent’s permission before using our Services.

Security

We are committed to protecting your data. Even though we take reasonable precautions to protect your data, no security measures can be 100% secure, and we cannot guarantee the security of your data.
